AROUND 10:00 A.M., C DOT CREWS DISCOVERED A CRACK IN A STEEL BEAM THAT CAUSED A DROP IN THE ROADWAY. THE CITY SAYS THE EXTREME COLD MAY HAVE CAUSED THE FRACTURE TO THE BEAM. OFFICIALS SAY THEY RECEIVED NO REPORTS OF INJURIES OR VEHICLE DAMAGE AND WHILE C DOT SAYS THERE IS NO FEAR OF A COLLAPSE THEY HOPE TO HAVE A TEMPORARY FIX IN PLACE BY RUSH-HOUR TOMORROW EVENING. THE CLOSURE CAUSED BACKUPS IN BOTH DIRECTIONS OF LAKE SHORE DRIVE TODAY NORTH OF GRAND PARK THOUGH THE SOUTHBOUND LANES REMAINED OPEN. MOTORISTS ARE BEING ADVISED TO AVOID THE AREA THROUGH TOMORROW. C DOT WILL PROVIDE UP ITS DATES THROUGHOUT THE DAY WHEN THE NORTHBOUND LANES MIGHT REOPEN.>>>WELL, 10 MORE CHICAGO MEN CONVICTED OF DRUG-RELATED CRIMES WERE EXONERATED FOUND TO BE FRAMED BY FORMER SERGEANT RONALD WATTS. IT BROUGHT 60 THE NUMBER OF MEN ALL AFRICAN-AMERICAN, WHO WERE WRONGFULLY CONVICTED BASED ON FABRICATED EVIDENCE BY WATTS AND OFFICERS IN A CORRUPT TACTICAL UNIT. THE ARRESTS AND CONVICTIONS OCCURRED DURING A 10-YEAR PERIOD BEGINNING IN 2002. WATTS WAS CONVICTED IN 2012 AFTER TRYING TO SHAKEDOWN AN F.B.I. INFORMANT. HE SERVED 22 MONTHS IN PRISON AND LIVES IN LAS VEGAS. NEARLY THREE DOZEN MORE CASES TIED TO WATTS AND OFFICERS ARE UNDER REVIEW.>>UP UNTIL TODAY IDA B. TODAY THE ILLINOIS ATTORNEY GENERAL AND THE SPECIAL PROSECUTOR IN THE VAN DYKE CASE ANNOUNCED THEIR PETITION FOR A WRIT OF MANDAMUS. WITH THAT THEY ARE SEEKING TO CHALLENGE THE LEGAULT OF VAN DYKE’S 81 MONTHS OF PRISON TIME. THE MOVE COMES AFTER CRIES OF FOUL FROM COMMUNITY ACTIVISTS AND LAQUAN McDONALD’S FAMILY, MEMBERS OVER THAT SENTENCE. JOINING US NOW ARE THOSE CHALLENGERS ILLINOIS ATTORNEY GENERAL KWAME RAOUL AND KANE COUNTY’S JUSTICE JOSEPH McMAHON WHO SERVED AS THE SPECIAL PROSECUTOR IN THE TRIAL. ATTORNEY GENERAL RAOUL WHICH IS A WRIT OF MANDAMUS?>>WELL, IT’S PROBABLY BEEN PRONOUNCED VARIED WAYS. BUT THAT’S THE WAY I PRONOUNCE IT. IT’S BASICALLY A PETITIONING THE SUPREME COURT TO ORDER A PUBLIC OFFICIAL TO DO WHAT THEY ARE LAWFULLY OBLIGED TO DO.>>AND IN THIS CASE YOU ARE ASKING THE SUPREME COURT TO ORDER THE TRIAL JUDGE TO RESENTENCE JASON VAN DYKE. HOW COME?>>TO RESENTENCE JASON VAN DYKE IN ACCORDANCE WITH THE LAW. AND THAT IS THE CRITICAL POINT HERE. IT IS NOT MANY PEOPLE ARE FOCUSED ON THE LENGTH OF SENTENCE. WHAT I BELIEVE Mr. McMAHON AND MYSELF ARE FOCUSING ON IS WHETHER OR NOT THE SENTENCE WAS RENDERED IN ACCORDANCE WITH THE LAW. IN OTHER WORDS, THERE WERE TWO CHARGES THAT HE WAS CONVICTED ON, AGGRAVATED BATTERY WITH A FIREARM AND SECOND DEGREE MURDER. HE WAS SENTENCED ON THE SECOND DEGREE MURDER COUNT. THE LAW WOULD DICTATE, WE BELIEVE, THAT HE SHOULD HAVE BEEN SENTENCED ON THE AG BAT WITH THE FIREARM COUNT, 16 SUCH COUNTS.>>THE JUDGE ADDRESSED THIS ISSUE OF WHICH OF THE JASON VAN DYKE SHOULD HAVE BEEN SENTENCED UNDER AND HE SAID IT WAS COMMON SENSE THAT KILLING SOMEONE WITH A GUN IS MORE SERIOUS THAN ASSAULTING SOMEONE WITH A GUN. TO THE AVERAGE PERSON MIGHT THINK YEAH, KILLING SOMEBODY WITH A GUN IS WORSE THAN ASSAULTING SOMEBODY WITH A GUN. AND IN FACT HE WAS SENTENCED FOR KILLING SOMEBODY WITH A GUN. WHY WAS THAT THE WRONG THING FOR THE JUDGE TO DO?>>SO WHAT THIS PETITION ASKS THE SUPREME COURT TO DO IS TO LOOK AT LEGALLY WHICH OFFENSE IS MORE SERIOUS. UNDER THE LAW THE AGGRAVATED BATTERY COUNT IS MORE SERIOUS BECAUSE IT CARRIES A POTENTIALLY LONGER PRISON SENTENCE. COMMON SENSE PERSPECTIVE, ABSOLUTELY. IT MAKES SENSE IF SOMEBODY IS CONVICTED OF MURDER OR SOME TYPE OF MURDER THAT THAT WOULD BE MORE SERIOUS THAN AGGRAVATED BATTERY. BUT LEGALLY WHAT WE HAVE TO LOOK AT AND WE HAVE ARGUED TO THE ILLINOIS SUPREME COURT, IS THAT BECAUSE THE SENTENCING RANGE FOR THE AGGRAVATED BATTERY COUNTS IS LONGER THAT IS IN FACT THE MORE SERIOUS OFFENSE THAT HE WAS CONVICTED OF.>>AS YOU KNOW, JASON VAN DYKE’S APPELLATE LAWYERS SEE IT DIFFERENTLY. LET’S LISTEN TO WHAT THEY HAD TO SAY.>>HE IS NOT A PERSON WATCHING THIS NEWSCAST TODAY THAT WOULD THINK THAT SHOOTING SOMEONE WAS LESS SERIOUS THAN SHOOTING AND KILLING SOMEONE. IN ESSENCE, WHAT THE SPECIAL PROSECUTOR AND THE ATTORNEY GENERAL ARE ARGUING TODAY IS THAT THE JUDGE ERRED WHEN HE SENTENCED Mr. VAN DYKE ON SECOND DEGREE MURDER AND SHOULD HAVE SENTENCED HIM ON AGGRAVATED BATTERY BECAUSE AGGRAVATED BATTERY IS MORE SERIOUS THAN SECOND DEGREE MURDER. THAT IS A LUDICROUS CONCLUSION AND THE LAW DOES NOT SUPPORT IT.>>KWAME RAOUL, IF WHAT THE JUDGE DID WAS CLEARLY ILLEGAL, WHY DID HE DO IT?>>I CANNOT EXPLAIN WHAT THE JUDGE MAY HAVE BEEN THINKING AT THE TIME. BUT THE JUDGE, HIMSELF, RELIED ON A DISSENTING OPINION IN THE PEOPLE V LEE CASE AND THAT IS UNUSUAL FOR ONE TO DECIDE ON A LONE DISSENTING OPINION TO RENDER THE DECISION.>>WHAT IS THE LEE CASE?>>THE PEOPLE V LEE DEALT WITH THE EXACT SAME CHARGES. IT WAS SECOND DEGREE MURDER AND AG BAT WITH A FIREARM CHARGE. THEY WERE FORCED TO MAKE A DECISION AS TO WHICH WAS THE MORE SERIOUS COUNT. AND THEY CHOSE AG BAT WITH A FIREARM. RARELY DO YOU HAVE CASES THAT ARE SO DIRECTLY ON POINT WITH REGARDS TO THE SPECIFIC JUXTAPOSITION OF THE TWO CHARGES.>>JOSEPH McMAHON YOU SAID THAT ONE OF THE REASONS YOU CONSIDER THE AGGRAVATED BATTERY TO BE A MORE SERIOUS CHARGE IS BECAUSE THE SENTENCE IS POTENTIALLY LONGER. IS THAT IN AND OF ITSELF WHAT DIFFERENTIATES A CRIME THAT IS MORE SERIOUS FROM ONE THAT IS LESS SERIOUS THE LENGTH OF THE SENTENCE?>>THAT IS ONE OF THE SIGNIFICANT FACTORS THAT THE ILLINOIS SUPREME COURT IN THAT PEOPLE VERSUS LEE DECISION RELIED ON. THEY LOOKED AT THE POTENTIAL SENTENCING RANGE OF THE TWO TYPES OF OFFENSES. AND THEY FOUND THEY LOOKED AT THE LEGISLATIVE INTENT WHEN THEY ADOPTED THOSE OFFENSES AND ASSIGNED A SENTENCING CATEGORY TO EACH CRIME. AND THE SUPREME COURT SAID THAT UNDER THOSE CIRCUMSTANCES IN THE LEE CASE, THAT AGGRAVATED BATTERY WITH A FIREARM IS MORE SERIOUS THAN SECOND DEGREE MURDER. JUDGE GAUGHAN REVIEWED THAT AND HE ADDRESSED SOME OF THE ARGUMENTS THAT WE MADE AT THE SENTENCING HEARING. AND HE FOUND SOME DISTINGUISHING FACTORS IN THE VAN DYKE CASE THAT HE RELIED ON FOR ENTERING HIS SENTENCE. BUT THE ILLINOIS SUPREME COURT HAS RULED IN THAT LEE CASE AS THE ATTORNEY GENERAL INDICATED, THAT THE AGGRAVATED BATTERY CHARGE IS THE MORE SERIOUS AND THAT IS WHY WE HAVE ASKED THE SUPREME COURT TO REVIEW THIS AND EITHER SEND IT BACK OR PROVIDE FURTHER CLARIFICATION ON THAT ISSUE.>>KWAME RAOUL, SAY THAT YOUR PETITION TO THE SUPREME COURT IS GRANTED AND THE CASE GOES BACK TO THE SENTENCING JUDGE BACK TO THE TRIAL JUDGE. WHAT SENTENCE WOULD YOU LIKE TO SEE? WHAT SENTENCE DO YOU THINK IT MORE APPROPRIATE?>>ONE THAT IS BASED ON THE AG BAT WITH A FIREARM COUNT AS MANDATED BY THE LAW. I YIELD TO THE DISCRETION OF THE TRIAL JUDGE, TRIAL JUDGE’S DISCRETION IN SENTENCING OUGHT TO BE AFFORDED GREAT DEFERENCE. SO THIS IS NOT A QUESTION OF WHAT KWAME RAOUL THINKS IS THE APPROPRIATE LENGTH OF SENTENCE. I WASN’T SITTINGS A JUDGE LISTENING TO THE FACTS AND WITNESSING THE WITNESSES TESTIFY AND TAKING ALL THAT INTO ACCOUNT. THAT IS WHY A TRIAL JUDGE’S DECISION IS TO BE AFFORDED DEFERENCE. HOWEVER, THAT TRIAL JUDGE MUST DO IT CONSISTENT WITH THE LAW AS THE LEGISLATURE SET IT OUT AND AS THE SUPREME COURT INTERPRETED IT.>>MY UNDERSTAND SOMETHING THAT IT COULD GO BACK TO THE TRIAL JUDGE AND HE COULD SAY ALL RIGHT FINE, I MADE A MISTAKE, I WILL SENTENCE BASED ON AGGRAVATED BATTERY INSTEAD OF KILLING, ISN’T IT POSSIBLE THAT THE SENTENCE COULD ESSENTIALLY BE SIMILAR TO WHAT HE HAS RECEIVED? WHAT JASON VAN DYKE HAS ALREADY RECEIVED?>>IT COULD BE. AND THE POINT OF THIS IS TO HAVE THE LAW FOLLOWED IN THIS CASE. IT’S NOT SO MUCH ABOUT WHAT THE ULTIMATE SENTENCE IS. JUDGE GAUGHAN’S DECISION IS ENTITLED TO GREAT, GREAT DEFERENCE. AND HE IS ENTITLED TO THAT. HE SAT THROUGH THE FACTS OF THE CASE AND WATCHED THE TRIAL AND LISTENED TO THE WITNESSES AT THE SENTENCING HEARING. ULTIMATELY HIS DECISION AS TO THE NUMBER WILL BE A DECISION HE GETS TO ARRIVE AT.>>DIDN’T HE SIGNAL THAT HE DID NOT THINK THAT A LENGTHY SENTENCE WAS APPROPRIATE?>>I THINK THAT’S A FAIR INTERPRETATION OF WHAT HIS SENTENCE WAS, YES.>>KWAME RAOUL, VAN DYKE’S ATTORNEYS ARE SAYING THIS IS A POLITICAL MOVE. THAT IT WAS AN ISSUE IN YOUR CAMPAIGN. WHY ARE YOU GETTING INVOLVED?>>IT IS MY CONSTITUTIONAL DUTY TO GET INVOLVED. AS THE ATTORNEY GENERAL IT’S MY CONSTITUTIONAL DUTY TO REPRESENT THE PEOPLE OF THE STATE OF ILLINOIS BEFORE THE SUPREME COURT. AND IF I SEE THAT THE LAW IS NOT BEING FOLLOWED IT IS MY RESPONSIBILITY TO DO SO. I THINK I SHOULD BE CLEAR ABOUT THAT. THIS, I PRESIDE OVER AN OFFICE WITH 400 LAWYERS. MY LAWYERS WERE LOOKING AT THIS CASE FOUR DAYS AFTER I TOOK THE OATH OF OFFICE. NOT BY MY DIRECTION. BECAUSE IT’S THEIR RESPONSIBILITY TO DO SO NOT ONLY IN THIS CASE BUT IN MANY OTHER CASES. AND SO THEY ON THEIR OWN STARTED LOOKING INTO THIS AND DAYS AFTER THEY APPROACHED ME ABOUT IT.>>JOSEPH McMAHON WHEN THE SENTENCING — CORRECT ME IF I’M WRONG — WHEN THE SENTENCE CAME DOWN YOU ACCEPTED IT. YOU EXPRESSED NO CRITICISM OF THE JUDGE OR OF THE SENTENCE. WHY DID YOU CHANGE YOUR MIND?>>SO THIS IS NOT A CRITICISM OF THE JUDGE. THIS IS AN ATTEMPT TO ASK THE SUPREME COURT TO ORDER THE JUDGE TO DO SOMETHING THAT IS REQUIRED TO DO BYLAW. ULTIMATELY, THE LENGTH OF THE SENTENCE THAT IS GOING TO BE HIS DECISION.>>WHY DID YOU CHANGE YOUR MIND?>>I HAVE NOT CHANGED MY MIND. I HAVE HAD THE BENEFIT SINCE THE SENTENCING IN JANUARY TO LOOK AT HOW HE WAS SENTENCED AND HOW THE LAW APPLIES TO THE FACTS OF THIS CASE. WE WERE AWARE OF THE LEE CASE AT THE TIME OF THE SENTENCING. WE ARGUED THE LEE CASE DURING THE SENTENCING HEARING. THE LEE CASE AND SOME OF THE OTHER CASES THAT WE CITED IN OUR PETITION FOR WRIT OF MANDAMUS. BUT THIS IS ABOUT SEEING THIS CASE THROUGH TO THE RIGHT OUT COME. AND ASKING THE SUPREME COURT TO REVIEW THE SENTENCE AND HOW THE SENTENCE WAS IMPOSED, I THINK IS AN IMPORTANT MESSAGE TO SEND ON THIS CASE, OF COURSE, BUT TO THE COMMUNITY AS WELL. IT IS A MINUSCULE PORTION BUT IT DOES NOT MEAN THAT TURNOUT ULTIMATELY IS GOING TO BE LOW. THE ELECTION BOARD’S JIM ALLEN POINTS TO OTHER INDICATORS THAT SIGNAL TURNOUT MIGHT BE HIGH ONCE ALL IS SAID AND DONE.>>VOTER INTEREST IS VERY STRONG WE HAVE MORE THAN DOUBLED OUR VOTE BY MAIL APPLICATIONS FOR EITHER 2011 OR 2015. WE HAVE 50,000 PEOPLE WHO HAVE APPLIED TO VOTE BY MAIL AND THE PREVIOUS ELECTIONS IT WAS LIKE 22000. PEOPLE ARE ENGAGED AND TUNED IN. AND THEY CAME OUT AND SAID THE INCOME TAX RATE NEEDS TO BE HIKED TO 5.95% FROM 4.95 AND THE CORPORATE HIKE HIKED FROM 7 TO 8%. THESE ARE NOT TAX AND SPEND LIBERALS. AND THE REACTION ON YOUR SIDE OF THE AISLE?>>WELL, I THINK THAT IT JUST SHOWS THAT SERIOUS THING PEOPLE REALIZE THE DEPTH OF THE PROBLEM WE ARE IN AND THERE ARE NOT GOING TO BE EASY SOLUTIONS. I THINK THE GOVERNOR’S TRANSITION REPORT AND WHAT THE CIVIC COMMITTEE SAID TELL US THAT WE ARE NOT GOING TO GET OUT OF THIS IN ONE YEAR. WE HAVE TO BE REALISTIC ABOUT WHAT OUR RESOURCES ARE AND CANNOT GET AHEAD OF OURSELF BY SPENDING TO THE POINT THAT THE ONLY WAY WE CAN PIVOT BACK TO THE TAX INCREASE.>>THEY ARE SUGGESTING $2 BILLION IN SPENDING CUTS AS WELL, CORRECT?>>YEP.>>HOW BIPARTISAN IS IT? AND IN 2015 THERE WAS A DRAMATIC SHIFT IN THE STORIES OF OTHERS. IN PARTICULAR, THE STORY OF AMERICAN PROMISE VIS-A-VIS IMMIGRANTS WAS BEGINNING TO CHANGE AND THE METAPHOR OF IMMIGRANTS OF HOPE AND INSPIRATION AND OPPORTUNITY WAS BEING REPLACED OF FEAR AND HATE AND LOST OPPORTUNITY. AND SO I FELT THAT I WANTED TO TRY TO MAKE SENSE OF THAT STORY AND BEGIN TO TELL THAT STORY IN NEW WAYS. AND REFUGEES IN PARTICULAR WERE IMPORTANT BECAUSE IF WE’RE FEARING AND HATING REFUGEES WE CAN FEAR AND HATE ANYONE. SO I DID WHAT I USUALLY DO, I GOT IN MY CAR WITH MY CAMERAS AND STARTING GOING OUT AND MEETING REFUGEES AND CAPTURING THEIR STORY.>>WE HAVE BEEN LOOKING AT SOME OF THE IMAGES AND THE SUBJECTS YOU ARE TALKING ABOUT. BUT ONE SUBJECT HE IS THE PERSON’S NAME IS AHMED. TELL US ABOUT HIM HE WAS A JOURNALIST.>>AHMED LIKE SO MANY OF THE REFUGEE SUBJECTS IN THE EXHIBITION IS INSPIRING IN MANY WAYS. AND ONE DAY HIS NEWS DIRECTOR GOT ASSASSINATED AND HE RECEIVED A MESSAGE THAT SAID YOU’RE NEXT. AND HE LITERALLY JUMPED UP WITH THE CLOTHES ON HIS BACK AND DROVE TO THE AIRPORT AND FLEW TO UGANDA. AND HE ESCAPED AND DID NOT SEE HIS FAMILY AGAIN FOR FIVE YEARS UNTIL THEY WERE REUNITED.>>KENNY KENESE YOU WERE A 20-YEAR-OLD COLLEGE STUDENT WHEN YOU LEFT MASSACRE AND LEFT BURUNDI AND THE FOLLOWING 10 YEARS INCLUDES HORRIFIC STORIES OF IMPRISONMENT AND TORTURE AND SPENT ONE YEAR ALONE IN THE JUNGLE. SHE EXPERIENCED THIS INCREDIBLE TRAUMA TO THE POINT NOW SHE IS A WOMAN OF FEW WORDS. AND SO WHEN I MET HER, I WAS INTERVIEWING HER AND I INTERVIEWED HER FOR HALF AN HOUR AND SHE SPOKE ABOUT FOUR SENTENCES IN THE ENTIRE HALF HOUR. FOR HER THAT WAS A HEROIC ACT TO SHARE THAT STORY AND SHARE IT AT ALL. AS A JOURNALIST IT HELD ME BECAUSE I FELT THAT I FAILED.
